On May 2, Northwestern National Insurance Company of Milwaukee, Wisconsin (“NNIC”) was ordered into liquidation by the Dane County Circuit Court in Wisconsin. The liquidation order also fixed November 2, 2019 as the claims filing deadline for all potential claimants. Policyholders, including those with contingent or IBNR claims, should file their proofs of claim by that date in order to preserve their rights to distributions of the estate’s assets.
NNIC was organized in 1869 and was licensed to do business in all states prior to being placed into run-off in 1986. NNIC was placed into rehabilitation in 2007 and exited from it in 2012. In May 2016, SOBC Sandal Holding Ltd. purchased NNIC from Armco Insurance Group, Inc. The board of directors unanimously consented to the liquidation because NNIC’s surplus continues to deteriorate and does not meet the minimum required by law. On July 17, the District Court of Travis County, Texas approved the motion filed by the Special Deputy Receiver of Highlands Insurance Company to set an October 31, 2019 deadline for policyholders with “undetermined contingent or unliquidated” claims against Highlands. Such policyholders must submit updated proofs of claim along with supporting documentation by the deadline, or their claims may be disallowed. The deadline does not provide an opportunity to submit new claims, only to update unresolved previously-field proofs of claim.
Highlands was placed in permanent receivership in Texas on November 6, 2003. Claimants were required to file proofs of claim, including contingent proofs of claim to preserve their rights, prior to March 30, 2007. Claims against Highlands under policies issued through the London Market were generally resolved through a Scheme of Arrangement in the United Kingdom. A claims update date for the Superior National companies (including Superior National Insurance Company, Superior Pacific Casualty Company, California Compensation Insurance Company, Commercial Compensation Casualty Company, and Combined Benefits Insurance Company) has been set for August 30, 2019. All claimants with unresolved claims wishing to share in any distributions of the estates must file claim update forms by that date. Only those claims that were liquidated or finalized by June 30, 2019 will be considered for allowance by the estates.
The Superior National companies were placed in statutory conservation in March of 2000, and then in liquidation in September 2000. The original proof of claim filing deadline was May 25, 2001. For more information, please see the California Conservation & Liquidation Office’s website.
