Our friend, Jim Conlan, has written an article explaining an alternative to bankruptcy reorganization for solvent companies seeking a permanent solution to their tort system liabilities. The process that Jim describes is the one that a number of defendants have followed resulting in claims continuing to be litigated and settled in the tort system under a new corporate parent unrelated to the original defendant. In KCIC's experience these arrangements have proven beneficial to all parties and avoid the high expense and extreme uncertainty of Chapter 11. We are seeing continued interest in exploring these types of transactions, both by buyers and sellers, and we expect to see many more in the future.
